Mastering Damages is a comprehensive and practical resource that explains the basic principles and concepts of the modern American law of Damages. Focusing primarily upon the legal remedy of money damages, this book explores the various rules and mechanisms by which damages are determined in many different areas of the law.
The book is divided into three main parts. Part I contains a thorough discussion of basic Damages terminology and legal principles that are applicable generally in regard to all types of damages litigation. Part II provides a detailed examination of the numerous issues relating to the computation and assessment of damages uniquely within the context of personal injury (and death) cases. Individual chapters examine the specific components of personal injury and death damages that may be recovered, as well as how such damages may be valued, along with explanations of the actual mechanics involved in making adjustments to account for the effects of “present value,” future inflation, and income taxes on a personal injury damage award. Part III of the book addresses a variety of unique and specialized damages issues that frequently arise within the context of certain other common types of damage litigation, including condemnation damages, breach of contract damages, and damages for a wide variety of different types of injuries to real and personal property.
Throughout, the book also provides numerous “Practical Tips” that offer specific suggestions for addressing or resolving a variety of specific damage-related issues often encountered by attorneys in various different litigation settings.
